Appendix B: Investigatory Team

  • The investigatory team shall be constituted by the President or his or her designee.
  • Membership of the investigatory committee may vary, but shall consist of both male and female Representatives.
  • Members of the investigatory team are not to serve as advocates or representatives of a constituency group; rather they are to serve as independent members of the larger College community.
  • As soon as practicable, the team shall meet to establish its own procedures and plan the investigation. Promptly following this initial meeting, the team shall assemble to commence its investigation.
  • During the course of its investigation, the team shall attempt to determine if discrimination/harassment has occurred, and if it has, shall submit a written report to the President or his/her designee.
  • In conducting an investigation, the team will do any of the following as it deems appropriate:
    • tape the proceedings
    • interview or request a written report from one of the College's Individual Rights Advisors
    • interview the complainant and record the details of the complaint and request that the complainant review and sign a document attesting to its accuracy. The documented record shall be made available to the respondent (alleged source of the discrimination/harassment), to allow for his/her response.
    • interview the respondent and record the details of the response and request that the respondent review and sign a document attesting to its accuracy. The documented record shall be made available to the complainant. A disclaimer form will be provided to the complainant indicating that they have listened to the report and the contents of the report have been explained to them. Should the respondent refuse to sign the disclaimer, the complaint may still proceed.
    • interview other individuals if they are deemed to have pertinent information, request such individuals review, and sign a document attesting to its accuracy. The documented record of such interviews will be provided to the complainant and respondent.
    • remind complainant, respondent, and all others involved as to the confidentiality of the matter under investigation and seek their verbal agreement to hold the information in confidence.
  • The Investigatory Committee will determine, based on the Investigation Report, whether the complaint has been substantiated or not and report to the President, or his/her designee.
